Terms of Service

The rules of the realm. Please read them. They cover your account, your items, fair play, and staying safe while you play in the real world.

1. Agreement

These Terms of Service are an agreement between you and the operator of SCAPED (“SCAPED”, “we”, “us”). They apply to the SCAPED iOS game and its online services. By creating an account or playing, you accept these terms and our Privacy Policy. If you don’t agree, please don’t use SCAPED.

2. Who can play

You must be at least 13 years old to play. If you’re under the age of majority where you live, or under the age at which you can consent to online services on your own (up to 16 in some EU countries), you may only play with a parent or guardian’s permission. That parent or guardian accepts these terms on your behalf.

3. Your account

  • You create an account with an adventurer name and password. Keep your password secret; you’re responsible for what happens on your account.
  • We don’t collect an email address, so we can’t recover a forgotten password. If you lose your password, you may lose access to your account.
  • Accounts are personal. Don’t sell, trade, share or transfer your account, or use someone else’s.
  • Tell us straight away at anthonyvvza@gmail.com if you think someone else has accessed your account.

4. Play safely in the real world

SCAPED is played in the real world. Your safety comes first, always, and it’s your responsibility.

  • Stay aware of your surroundings. Watch for traffic, cyclists, people, obstacles and uneven ground. Don’t look at your screen while crossing a road.
  • Never play while driving or operating any vehicle, including a bike or scooter.
  • Don’t trespass. In-game trees, water, rocks, monsters and markets may appear near private property, water, roads, railways, construction sites or other unsafe or restricted places. Their presence in the game doesn’t mean you’re allowed to go there or that it’s safe. Obey the law, signs and local rules.
  • Don’t enter water, climb, or go anywhere unsafe to reach something in the game. Nothing in SCAPED is worth risking your safety.
  • Be careful at night, in unfamiliar areas, and in bad weather. Consider playing with others.
  • Map features come from OpenStreetMap and automated processing, so they may be inaccurate, outdated or incomplete.
  • Walking and step goals aren’t medical advice. Stop if you feel unwell, and check with a doctor before a big increase in physical activity.

5. Virtual items and currency

  • SCAPED is free to play and currently has no in-app purchases.
  • Coins, items, rare drops, XP, levels and other game content are a limited, personal, revocable licence to use inside the game. You don’t own them, and they have no real-world money value.
  • You may not sell, buy or trade accounts, items or coins for real money or anything outside the game (“real-world trading”).
  • To fix bugs, remove exploited or cheated progress, or keep the game balanced, we may change, reset, remove or rebalance items, drop rates, stats and progress. We won’t do this arbitrarily.

6. Fair play

You agree not to:

  • Fake or spoof your location, or use emulators, jailbreak tweaks or other tools to manipulate GPS, step counts or game data.
  • Use bots, scripts, macros, modified clients, or anything that automates play or gives an unfair advantage.
  • Exploit bugs or glitches instead of reporting them. Please report them to support.
  • Tamper with, reverse engineer or overload our servers or API, or access other players’ data. Reverse engineering is allowed only where the law expressly permits it.
  • Harass, threaten, impersonate or scam other players, or use SCAPED for anything illegal.

7. Adventurer names and the GLOBAL feed

Your adventurer name and level-ups are visible to other players. Names must not be offensive, hateful, sexual, threatening or impersonating, and must not contain someone else’s personal information or advertising. We may rename or remove any account whose name breaks these rules, with or without notice.

8. Enforcement

If you break these terms, we may, depending on how serious it is, warn you, reset or remove progress or items, rename your adventurer, or temporarily or permanently suspend or delete your account. Where reasonable, we’ll tell you why. If you think we got it wrong, contact support.

9. The service

SCAPED is a live game that keeps changing. We may add, change or remove features, skills, monsters, items and content. SCAPED needs an internet connection and location services. We work to keep it running, but can’t promise it will always be available, error-free or compatible with every device. We may also stop offering SCAPED altogether; if we do, we’ll try to give reasonable notice in the app.

10. Ownership

SCAPED’s software, name, logo, artwork, characters, sounds and other content belong to the operator of SCAPED or its licensors. You get a personal, non-exclusive, non-transferable, revocable licence to play SCAPED on Apple devices you own or control, for personal, non-commercial use, under these terms and Apple’s Usage Rules.

SCAPED is an independent game. It is not affiliated with, sponsored by or endorsed by any other game publisher. Map data © OpenStreetMap contributors, available under the Open Database License. The pixel font Tiny5 is used under the SIL Open Font License.

11. Third-party services

SCAPED uses third-party services for maps, weather, hosting and Apple features (see the Privacy Policy). We don’t control those services and aren’t responsible for how accurate or available they are.

12. Disclaimers

As far as the law allows, SCAPED is provided “as is” and “as available”, without any warranties beyond those the law requires. We don’t promise that map features, locations, weather or step counts are accurate, or that progress can never be lost. Nothing in these terms limits your statutory consumer rights.

13. Liability

As far as the law allows, SCAPED and its operator are not liable for indirect or consequential loss, or for injury, damage or loss caused by how you play in the real world, including going onto private property or into unsafe places, or by using the app while not paying attention to your surroundings. Because SCAPED is free, our total liability for any claim is limited to €50. We don’t exclude or limit liability for death or personal injury caused by our negligence, for fraud, or for anything else that can’t be limited by law.

14. Ending your account

You can stop playing and delete your account and data at any time in the app: Backpack › Account settings › Delete account and all data. This is permanent. We may end these terms or your access as described in section 8, or if we stop offering SCAPED.

15. Apple

These terms are between you and us, not Apple. Apple isn’t responsible for SCAPED or its content, and has no obligation to provide maintenance or support for it. To the extent any warranty applies, and as far as the law allows, Apple has no other warranty obligation. Apple isn’t responsible for any claims relating to SCAPED, including product-liability claims, claims that it fails to meet legal or regulatory requirements, consumer-protection claims, or intellectual-property claims. You confirm you’re not located in a country subject to a U.S. government embargo and aren’t on any U.S. government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

16. Governing law

These terms are governed by Dutch law, and disputes will be heard by the competent court in the Netherlands. If you’re a consumer living elsewhere in the EU, you keep the protection of the mandatory laws of your country and may also bring a claim there.

17. Changes

We may update these terms as SCAPED evolves. We’ll change the effective date above and, for significant changes, tell you in the app before they take effect. If you keep playing after that, you accept the new terms.
